LOSS OR DAMAGE IN TRANSIT. The risk in the goods passes to the Customer when the goods depart from our Company to the Carrier, and the Company accepts no responsibility for any damage, shortage or loss during unloading or transit from the point of delivery, whether or not the Company makes the arrangements. Claims for any such damage, shortage or loss in transit should be made on the carrier, in accordance with the terms of the carrier.
LIMITATION OF LIABILITY. Jefferson Memorial Funeral Home, including its affiliates and parent (collectively, “company”), makes no warranty of merchantability or fitness for any particular purposes and makes no express or implied warranty when selling these third-party products. A buyer’s recovery for damages resulting from any and all causes whatsoever, including, but not limited to breach of contract, breach of warranty, negligence, or strict product liability will be exclusively limited to the replacement of the products with respect to which losses or damages are claimed or to a refund of any purchase price paid for the products. In no event will the company be liable to any buyer or user of the products for incidental or consequential damages or for any other damages to the property or person of the buyer or user.
PROBLEMS, ISSUES OR REFUND REQUESTS: Any issues or refund requests on the sale of any goods, other than loss or damage in transit, shall be directed to Jefferson Memorial Funeral Home, Inc., at 301 Curry Hollow Road, Pittsburgh, PA 15236 or by email at info@jeffersonmemorial.biz within thirty days of the point of delivery date of the product by the Buyer.
